Terms and conditions

The arrangements that apply to quotes, assignments and working with Beyond3D.

01 — Applicability

These terms and conditions apply to all quotes, assignments and agreements between Beyond3D and the client, unless expressly agreed otherwise in writing.

Deviations apply only when confirmed in writing. Any purchasing or other conditions of the client are expressly rejected.

02 — Quotes and assignments

Quotes are without obligation and valid for thirty days, unless stated otherwise. An assignment is established when the client approves a quote in writing or by email.

The quote describes the scope: the number of images or seconds of animation, the number of revision rounds and the delivery form. Work outside that scope is additional work and is agreed in advance and quoted separately.

03 — Delivery of material and planning

The client provides the required source material in good time and in full, such as drawings, 3D models, material and colour specifications and references. Schedules are an estimate and start from the moment the source material is complete and the concept approved.

Delays in the delivery of material or in client feedback may shift the schedule and delivery accordingly.

04 — Revisions

The number of revision rounds is set out in the quote. A revision round involves collecting and processing coherent feedback.

Changes resulting from a modified design, a changed scope or feedback after an agreed approval moment count as additional work.

05 — Way of working and location

Beyond3D carries out visualisation and animation assignments from its own studio. Briefing and alignment take place remotely, via call, shared references and clear interim rounds.

For live productions such as shows, musicals and festivals, on-site support during technical rehearsals or build-up may be part of the assignment. This is then explicitly included in the quote.

06 — Payment

Unless agreed otherwise, part of the project amount is invoiced at the start and the remainder on delivery. Invoices are paid within fourteen days of the invoice date.

In the event of late payment, Beyond3D may suspend the work. In the event of default, statutory interest and reasonable collection costs are due.

07 — Intellectual property and usage rights

After full payment, the client obtains the right to use the delivered images and animations for the agreed purposes, such as sales, marketing, press and presentation.

Source files, 3D models and project scenes remain the property of Beyond3D, unless their transfer is separately agreed. Beyond3D may show the work in its own portfolio and communication, unless agreed otherwise in writing, for example under confidentiality.

08 — Liability

Beyond3D carries out every assignment to the best of its insight and ability. Liability is limited to the invoice amount of the relevant assignment and does not apply to indirect or consequential damage.

Beyond3D is not liable for inaccuracies arising from source material supplied by the client or from approved interim results.

09 — Applicable law

Dutch law applies to all agreements with Beyond3D. Disputes are submitted to the competent court in the district where Beyond3D is established.
